Aspetos Gerais

A utilização da Loja Online da Márcio Lopes Lda, requer a aceitação plena e sem reservas de todas as disposições incluídas nos Termos e Condições vigentes. Caso não aceite integralmente cada uma das condições apresentadas, não deverá aceder à Loja Online.

A Loja Online reserva-se no direito de, a todo o momento e sem aviso prévio, com efeitos imediatos, modificar unilateralmente a apresentação e configuração do Website e as condições requeridas para aceder e/ou utilizar o mesmo.

Os produtos de teor alcoólico disponíveis na loja online, apenas poderão ser adquiridos por indivíduos com idade legal para consumo de bebidas alcoólicas e que não apresentem qualquer impedimento ou restrição legal que os impeça de adquirir bebidas alcoólicas.

O serviço da Loja Online está, por enquanto, apenas disponível estritamente ao território continental e ilhas de Portugal.

Pagamentos

A Marcio Lopes Lda disponibiliza aos seus clientes da Loja Online o pagamento por cartões de crédito e débito (Visa, Mastercard e American Express) e por MB WAY através de cartões MB NET.

As encomendas serão expedidas após liquidação do pagamento.

A Loja Online empregará os seus esforços para garantir a máxima confidencialidade e segurança nos dados transmitidos através da internet.

Preços

Os preços dos produtos estão apresentados em euros (€) na Loja Online e incluem IVA às taxas legais em vigor ao abrigo da legislação portuguesa. Qualquer alteração à taxa do IVA aplicável será refletida nos preços dos produtos. Desta forma os preços poderão ser modificados a qualquer momento a partir da data de alteração da taxa do IVA aplicável.

Os preços dos produtos disponíveis na Loja Online podem ser alterados sem aviso prévio e encontram-se sempre sujeitos a rutura de stock.

As promoções realizadas na Loja Online poderão não ser aplicadas noutras espaços ou parceiros onde os vinhos da Márcio Lopes Lda se encontram à venda.

O custo do transporte em Portugal Continental depende do peso e do valor total da encomenda. Para encomendas a partir de 50€, entregues em Portugal Continental, o custo do transporte é gratuito. O custo do transporte de encomendas que não atingirem o valor mencionado será de 6€ para o cliente. O valor relativo ao custo de transporte é apresentado antes do cliente finalizar o pagamento.

Encomenda

O cliente poderá efetuar a sua encomenda na Loja Online através do registo no Website ou do preenchimento dos dados necessários para faturação e expedição. O cliente deverá seguir todos os passos do processo de encomenda e após finalizar a mesma receberá um email automático, no qual poderá verificar os dados introduzidos e solicitar a sua alteração imediata através do email loja@mlw.pt.

Os produtos disponíveis para venda na Loja Online estão sujeitos ao stock existente e as encomendas serão processadas por ordem de chegada. Em caso de rutura de stock, temporária ou definitiva, o cliente será devidamente avisado.

Entrega

As encomendas efetuadas na loja Online da Márcio Lopes Lda. serão enviadas após confirmação de stock e pagamento. Salvo situações de rutura de stocks ou alheias à Marcio Lopes Lda. (ex: desastres naturais, acidentes rodoviários, situação de pandemia, estado de emergência) serão entregues até 5 dias úteis, em Portugal Continental.

A loja online compromete-se a entregar os produtos encomendados com a maior brevidade possível.

As encomendas serão entregues de acordo com os horários de entrega das transportadoras (dias úteis das 09:00h às 18:00) na morada indicada pelo utilizador. Não será possível efetuar a entrega em apartados.

Todos os envios feitos para fora Portugal Continental são acompanhados por documento administrativo de acompanhamento (DAA).

As encomendas expedidas devem ser verificadas pelo cliente aquando da sua recepção. Em caso de danos ou irregularidades na embalagem, o cliente deverá proceder à devolução à transportadora, indicando o motivo da mesma na guia de remessa e a informar a Marcio Lopes Lda., que se compromete a resolver com a maior celeridade possível o ocorrido.

Caso a encomenda não seja entregue por razões de ausência do cliente e a mesma voltar para a Marcio Lopes Lda. o valor do reenvio será cobrado ao cliente.

Devoluções

A Loja Online permite a devolução dos produtos num prazo de 14 dias dos produtos adquiridos nos termos do decreto-lei nº 143/2001 e decreto-lei 82/2008 de 20/5. Contudo, a devolução só será aceite caso os produtos permaneçam intactos (incluindo embalagens que acompanham o produto, rótulos e contra-rótulos), caso contrário a devolução fica sem efeito.

Para que os procedimentos de devolução e reembolso do montante ao utilizador sejam facilitados, solicita-se que o mesmo ponha o material objeto da resolução à disposição da Marcio Lopes Lda., dentro de um prazo de tempo razoável e com o objetivo de facilitar o exercício dos seus direitos e proceder à verificação do material. Para que o utilizador possa exercer o seu direito de resolução, deverá notificar a Márcio Lopes Lda. da decisão de resolução do contrato através de uma declaração clara por correio eletrónico para o endereço info@mlw.pt Nesta declaração deverá referir o número da encomenda e da fatura e a(s) referência(s) do(s) artigo(s) que pretende devolver. Após receção dessa declaração, a Márcio Lopes enviará por e-mail as indicações de devolução (procedimentos a seguir), juntamente com a informação acerca do meio de transporte (empresa transportadora) a utilizar. Para que o prazo de livre resolução seja respeitado, é necessário que se transmita a comunicação relativa ao exercício do direito de resolução antes do fim do prazo conferido para esse efeito: ou seja, 14 (catorze) dias após a receção.

Uma vez recebidos os produtos pela Marcio Lopes Lda e após validação do estado dos mesmos, o cliente será reembolsado de todos os pagamentos efetuados, incluindo os custos de entrega (com exceção de custos suplementares resultantes da sua escolha de uma modalidade de envio diferente da modalidade menos onerosa de envio normal pela Marcio Lopes Lda oferecida).

Terms and Conditions

General Aspects

The use of the Márcio Lopes Lda Online Store requires full and unreserved acceptance of all provisions included in the current Terms and Conditions. If you do not fully accept each of the conditions presented, you should not access the Online Store.

The Online Store reserves the right, at any time and without prior notice, with immediate effect, to unilaterally modify the presentation and configuration of the Website and the conditions required to access and/or use it.

Alcohol content products available in the online store can only be purchased by individuals of legal age to consume alcoholic beverages and who do not present any legal impediment or restriction that prevents them from purchasing alcoholic beverages.

The Online Store service is, for the time being, only available strictly to the mainland and islands of Portugal.

Payments

Marcio Lopes Lda provides its customers various payment options: credit and debit cards (Visa, Mastercard and American Express) and by MB WAY through MB NET cards.

Orders will be shipped after payment has been settled.

The Online Store will use its best efforts to ensure maximum confidentiality and security in the data transmitted over the internet.

Prices

The prices of the products are presented in euros (€) in the Online Store and includes VAT at the legal rates under Portuguese legislation. Any change to the applicable VAT rate will be reflected in the product prices. In this way, prices may be modified at any time from the date of change of the applicable VAT rate.

The prices of the products available in the Online Store can be changed without prior notice and are always subject to out of stock.

Promotions carried out in the Online Store may not be applied in other spaces or partners where Márcio Lopes Lda wines are on sale.

The cost of transport in Portugal mainland depends on the weight and total value of the order. For orders from €50, delivered in Portugal mainland the cost of transport is free. The cost of transporting orders that do not reach the mentioned value will be €6 for the customer. The value related to the transport cost is presented before the customer finalizes the payment.

Order

The customer can place his order in the Online Store by registering on the Website or filling in the necessary data for invoicing and shipping. The customer must follow all the steps of the ordering process and after completing the order, he will receive an automatic email, in which he will be able to verify the data entered and request its immediate change through the email loja@mlw.pt.

The products available for sale in the Online Store are subject to existing stock and orders will be processed on a first-come, first-served basis. In the event of a temporary or permanent out of stock, the customer will be duly notified.

Delivery

Orders placed in the Márcio Lopes Lda Online store will be sent after confirmation of stock and payment. Except when the respectives products are out of stock or when unrelated situations to Marcio Lopes Lda. (eg natural disasters, road accidents, pandemic situation, state of emergency) they will be delivered within a period of 3 to 5 working days, in Portugal mainland.

The online store undertakes to deliver the ordered products as soon as possible.

Orders will be delivered according to the delivery times of the carriers (working days from 09:00h to 18:00h) at the address indicated by the user. It will not be possible to deliver to PO Boxes.

All shipments outside Portugal mainland are accompanied by an accompanying administrative document (AAD).

Orders shipped must be verified by the customer upon receipt. In case of damage or irregularities in the packaging, the customer must return it to the carrier, indicating the reason for the same in the packing slip and inform Marcio Lopes Lda., who undertakes to resolve the incident as quickly as possible.

If the order is not delivered due to the customer’s absence and it returns to Marcio Lopes Lda., the reshipment amount will be charged to the customer.

Returns

The Online Store allows the return of products within 14 days of products purchased under the terms of decree-law nº 143/2001 and decree-law 82/2008 of 20/5 in the Portuguese constituiton. However, the return will only be accepted if the products remain intact (including packaging that comes with the product, labels and back labels), otherwise the return is void.

In order for the procedures of return and refund the amount to the user to be facilitated, it is requested that the user make the material object of the resolution available to Marcio Lopes Lda., within a reasonable period of time and with the aim of facilitating the exercise of their rights and proceed with the verification of the material. In order for the user to exercise his right of withdrawal, he must notify Márcio Lopes Lda. of the decision to terminate the contract through a clear statement by email to the address loja@mlw.pt. In this statement, he must mention the order number and of the invoice and the reference(s) of the item(s) you wish to return. Upon receipt of this declaration, Márcio Lopes will send by e-mail the return instructions (procedures to follow), together with information about the means of transport (carrier company) to be used. In order for the free withdrawal period to be respected, it is necessary to transmit the communication regarding the exercise of the right of withdrawal before the end of the period granted for this purpose: that is, 14 (fourteen) days after receipt.

Once the products have been received by Marcio Lopes Lda and after validating their status, the customer will be reimbursed for all payments made, including delivery costs (with the exception of additional costs resulting from choosing a shipping method other than the cost of normal shipping offered by Marcio Lopes Lda).
